Terms of Service

These Terms of Service ("Terms") govern your use of Cash4Exotics ("Cash4Exotics," "we," "us"), including app.cash4exotics.com and cash4exotics.com (the "Platform"). By creating an account or using the Platform, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Platform.

1. What Cash4Exotics is — and isn't

Cash4Exotics is a referral and matchmaking platform. We help exotic and luxury vehicle buyers, sellers, owners, influencers, businesses, and rental companies find and contact each other. That's all we do.

• We are not a car dealer, broker, auctioneer, lender, escrow agent, insurer, or rental company.
• We never take ownership or possession of any vehicle, never hold anyone's money for a vehicle sale, and never negotiate on anyone's behalf.
• We are not a party to any sale, rental, sponsorship, financing, or other deal between users. Any deal you make is solely between you and the other party.
• Our fees are for access to the Platform and are never based on whether a sale closes.

2. Eligibility and accounts

• You must be at least 18 years old and able to form a binding contract.
• Give us accurate information, including your real name, and keep it up to date. One person, one account — don't impersonate anyone or create accounts for someone else without their permission.
• You're responsible for everything done through your account. Keep your login secure and tell us right away at cj@cash4exotics.com if you think it's been compromised.
• If you use the Platform on behalf of a business, you confirm you're authorized to bind that business to these Terms.

3. Verification and review

We manually review some profiles, listings, and documents (for example, buyer proof of funds or pre-qualification letters, and seller title or registration documents). Our review is limited and is not a guarantee of anyone's identity, finances, ownership, honesty, or the condition, history, or value of any vehicle. A "verified" badge only means we looked at what was submitted and it appeared acceptable at that time. We may approve, reject, or remove anything at our discretion.

Always do your own due diligence before any deal: inspect the vehicle, run a vehicle history report, confirm the title and any liens, verify identity, and use secure payment methods. Never wire money to someone you haven't verified.

4. Listings and content you post

• You're responsible for everything you post — listings, photos, profile details, follower counts, and messages — and it must be accurate and lawful.
• If you list a vehicle, you confirm you own it or are legally authorized to sell or rent it, and that you'll disclose known material issues (such as salvage or rebuilt title, liens, or major damage).
• You keep ownership of your content. You give us a non-exclusive, royalty-free, worldwide license to host, display, and share it on the Platform and to promote the Platform (for example, featuring a listing), for as long as it's on the Platform.
• We may edit, hide, or remove content that breaks these Terms or that we think is risky.

5. Messaging and deals between users

Verified users can message each other directly. When both sides indicate they want to move forward, we may ask for additional verification. You're responsible for your communications and any agreement you make. Our team may review messages when needed for safety, to investigate reports, or to enforce these Terms. Don't use contact information you get through the Platform for spam or anything unrelated to the connection you made here.

6. Sponsorships, influencers, and rentals

• Sponsorship and rental arrangements between owners, influencers, businesses, and rental companies are made directly between those parties. Follower and view counts are self-reported; we don't verify them.
• Sponsorship disclosure: if you receive payment, free products or services, or any other benefit from a business you connected with through Cash4Exotics, you must clearly disclose that relationship in your posts and content as required by the U.S. Federal Trade Commission's Endorsement Guides (for example, "#ad" or "Paid partnership with…") and by each social platform's rules. You're solely responsible for your own compliance.
• Rental companies and owners who rent vehicles are responsible for their own licensing, insurance, registration, rental agreements, and compliance with local law.

7. Partners, financing, and escrow

We may show links to, or introduce you to, third-party partners such as lenders, escrow and transaction services, and logistics providers. Those partners are independent businesses with their own terms and privacy policies; we don't control them and aren't responsible for their services, approvals, or decisions. Any financing or escrow service is provided by that partner, not by Cash4Exotics. Cash4Exotics may receive compensation from partners when you click a partner link or use their services. This never changes the price you're offered by the partner.

8. Subscriptions and payments

• Some features require a paid subscription. Prices and what's included are shown before you pay. During our current beta onboarding phase, access is free; we'll tell you before any paid plan applies to you.
• Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel any time from your dashboard; cancellation takes effect at the end of the current period.
• Fees are non-refundable except where a specific guarantee shown in the app applies (such as the Seller 30-day match guarantee) or where required by law.
• We may change prices going forward with notice. Changes won't apply to a period you've already paid for.

9. Things you may not do

• Post false, misleading, or fraudulent listings, documents, or information.
• Scam, harass, threaten, or discriminate against anyone.
• List stolen vehicles or vehicles you don't have the right to sell or rent.
• Upload someone else's documents or personal information without permission.
• Scrape, copy, or resell Platform data, or contact users in bulk.
• Try to get around our verification, security, or payment systems, or access accounts or data that aren't yours.
• Use the Platform for anything illegal, including money laundering.

10. Suspension and termination

You can delete your account any time from your dashboard. We may suspend or close accounts, or remove content, if we believe you've broken these Terms, created risk for other users, or for legal reasons. Sections that by their nature should survive (such as disclaimers, limits on liability, and indemnification) survive termination.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T GUARANTEE ANY MATCH, SALE, SPONSORSHIP, RENTAL, OR FINANCING OUTCOME, OR THAT THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER OR PARTNER, OR FOR ANY VEHICLE.

12. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, CASH4EXOTICS AND ITS OWNERS, EMPLOYEES, AND AGENTS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR ANY LOSS ARISING FROM A DEAL OR DISPUTE BETWEEN USERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.

13. Indemnification

You agree to defend and hold harmless Cash4Exotics from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your content, your deals or interactions with other users, or your violation of these Terms or the law.

14. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at cj@cash4exotics.com and try to resolve it informally for at least 30 days. Any claim that isn't resolved informally will be brought in the state or federal courts located in North Carolina, and you and we consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms. If we make material changes, we'll notify you in the app or by email before they take effect. Continuing to use the Platform after that means you accept the updated Terms.
